Terms of service

1. Acceptance
By creating an account or using ELAREH, you agree to these Terms. If you do not agree, do not use the service.
2. Who we are
ELAREH is currently operated under the ELAREH brand; a specific registered legal entity has not been designated. Contact: [email protected] (privacy), [email protected] (security), [email protected] (accessibility).
3. Service description
ELAREH operates a talent verification and assessment network: skill assessments (multiple question formats, captured as real work samples — objective question types and coding questions are scored automatically, including automated test execution for supported coding languages in a sandboxed runner; every other format, and any automated result that lands close to the pass mark, is always reviewed by a human before it counts), structured interviews (typed responses today; audio/video capture and transcription are on our roadmap, not live), a talent marketplace, portable candidate credentials (the "Passport"), and examination services delivered directly or through examination centres and issuing authorities that ELAREH has internally verified through its own admin review (this is ELAREH's own verification decision, not a claim of external licensing or accreditation).
4. Eligibility and accounts
You must be at least 16 years old to use ELAREH. You must provide accurate information and keep your credentials secure. Candidate accounts belong to individuals; employer workspaces are administered by the organisation that created them. We may require identity verification before high-stakes assessments or credential issuance. You may sign in with Google; we store only your name, email, and email-verification status from that connection — no OAuth tokens are retained.
5. Candidate responsibilities
You may not attempt to take an assessment on another person's behalf, share live assessment content, interfere with integrity controls, or misrepresent your identity during verification.
6. Employer responsibilities
Employers are responsible for the accuracy of job postings and for their own hiring decisions. ELAREH provides evidence — verified skills, scores and interview records — never a hiring verdict. Match percentages are calculated from role requirements and verified credentials only.
7. Examination and assessment rules
Assessment results and credentials describe performance on a specific assessment at a specific time. Credentials carry validity periods and can be revoked for integrity violations, with notice and an appeal path. Where remote integrity monitoring is used, its scope and retention are disclosed before you consent, and consent is per-assessment — monitoring signals are reviewed by trained people; no automated decision alone labels a candidate as having cheated.
8. Integrity / prohibited conduct
No scraping of candidate data, no discrimination on protected characteristics, no resale of assessment content, no attempts to de-anonymise integrity review data, no attempting to defeat or bypass identity verification or exam-integrity controls, no fraud or misuse of the payment system.
9. Credentials and the Passport
Candidates control Passport visibility per section: private, visible to employers they apply to, or public via a share link. A credential's validity period, revocation status, and (where applicable) revocation reason are shown to anyone who verifies it — without exposing information the candidate hasn't chosen to share.
10. Marketplace, job postings, and intellectual property
Employers publish job postings and manage applications. ELAREH does not guarantee hiring outcomes and is not a party to any employment relationship formed through the platform. You retain ownership of content you submit (assessment answers, interview responses, job postings). You grant ELAREH the license needed to operate the service on that content — storing it, displaying it to authorised viewers per your visibility settings, and using it to generate the score or evidence the service exists to produce. ELAREH owns the platform itself.
11. AI-assisted functionality and human oversight
AI assists with drafting assessment blueprints from job descriptions, drafting interview follow-up questions, and surfacing integrity signals for human review. AI does not make hiring decisions, does not reject a candidate on an unreviewed integrity flag, and does not infer characteristics from face, voice, accent, name, or location. A human confirms interview evaluations, integrity decisions, and credential revocations before they take effect.
12. Payments and refunds
Prices are referenced in USD and settled in cryptocurrency through our payment processor, NOWPayments. The exact crypto amount, network, and rate-validity window are stated on each invoice. ELAREH never holds your private keys. The price and funding arrangement for an order are fixed at the moment it is created; a later change to our published pricing never changes the amount owed on an order you already placed.
Who pays for an assessment depends on the offering: an employer may sponsor the full fee for their pipeline, a candidate may pay the full fee themselves, or the fee may be split between employer and candidate, each funding their own defined share. Some assessments are also available as a public purchase, bought directly by a candidate with no employer, job listing, or invitation attached. The applicable arrangement, and each party's share, is always shown before you pay.
Fees are non-refundable except where required by applicable law or explicitly granted by ELAREH at its own discretion. Where ELAREH does grant a refund, every refund requires a second, independent administrator's approval before it is sent. For an order funded by more than one party, a refund is issued against each party's own paid share of that order — it does not redirect one party's payment to another. Cryptocurrency is our settlement rail, not our refund processor: an approved refund is sent by an authorized ELAREH administrator directly to your confirmed address, and ELAREH does not commit to a specific completion time, since sending and blockchain confirmation happen outside our own systems.
13. Suspension and termination
We may suspend or terminate an account, or revoke a credential, for violations of these Terms — including the prohibited conduct listed above, integrity violations, or fraud — with notice where practicable, and, for credential revocation, an appeal path.
14. Service changes and availability
We may change or discontinue features. Features described as "Roadmap" on the site are not yet available and their delivery is not guaranteed by any date.
15. Disclaimers
The service is provided "as is" and "as available," to the maximum extent permitted by applicable law. We do not guarantee uninterrupted or error-free operation, and — consistent with §6 above — we do not guarantee any hiring, employment, or interview outcome.
16. Limitation of liability
To the maximum extent permitted by applicable law, ELAREH is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any direct damages arising from these Terms or your use of ELAREH is limited to the total fees you paid ELAREH in the 12 months before the claim arose. Nothing in these Terms limits liability for ELAREH's own gross negligence, willful misconduct, fraud, personal injury or death caused by our negligence, or any other matter that cannot lawfully be limited under applicable law.
17. Indemnity
You agree to indemnify ELAREH against claims arising from your violation of these Terms or the prohibited conduct listed in §8.
18. Disputes and governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction over any dispute arising from these Terms or your use of ELAREH. ELAREH does not require mandatory arbitration; you retain the right to bring a claim in those courts. If you are a consumer based outside the UK, mandatory local consumer-protection law may still give you rights or a forum in your own country regardless of this clause.
19. Changes to these Terms
We update the effective date below whenever these Terms change, and describe material changes on this page. We do not yet send an account-wide notification for every change — check the effective date if you want to confirm nothing has changed since your last visit.
